It is required under the Civil Procedure Rules (CPR) that parties should make all reasonable efforts to settle their dispute before resorting to litigation.
Civil litigation can be complex and lengthy, we aim to provide advice that is easy to understand. We advise at an early stage and throughout the process on the prospects, as well as ensuring that pre-action protocols are complied with. Our services include collating relevant evidence, drafting documents and dealing with correspondence with the other side. We also prepare and issue proceedings if necessary. Thereafter we provide advice going forward, including in respect of court directions and making any applications.
We advise from the outset on any relevant limitation period by which a claim needs to be issued at court. Any claim not issued in time would become statute barred.
Funding
We offer very competitive rates and will provide, from the outset, an estimate of the likely costs involved and continuously advise on costs as the matter progresses.
We always aim to offer cost effective legal advice and can, for some work, offer fixed fees.
If a case is successful, the usual rule that applies is that the losing party pays the winning parties’ costs. Therefore, it is possible to recover some, if not all, of the costs incurred upon successful conclusion of a case. This would depend on the type of matter and does not apply to small claims (typically those with a value of under £10,000).
We do not hold a legal aid contract for civil work and therefore we cannot offer legal aid for any civil dispute.
On some occasions, individuals will have the benefit of legal expenses cover or Before the Event Insurance (BTE). This often has the benefit of both covering your legal expenses and any adverse costs or disbursements if you were to lose your case. It is always worth enquiring whether such cover exists as a means of funding a claim.
